Terms of Service

1. The Service

Peak Enterprise operates a software-as-a-service platform for consumer-product brands (the “Service”). These Terms govern your access to and use of the Service.

2. Your account

You are responsible for safeguarding your credentials and for any activity under your account. Notify us at /contact if you believe an account has been accessed without authorisation.

3. Your data

You retain ownership of the data you upload to the Service. We process it under contract to deliver the Service. You can export everything you own at any time. See the Privacy Policy and the Data Processing Agreement for the specifics.

4. Payments

Subscription fees are billed in the currency and on the cadence you selected at signup. Payment processing fees billed by Stripe or Square are paid directly to those providers at their published rates; Peak Enterprise does not mark them up.

5. Termination

You may cancel at any time. We may suspend or terminate the Service for material breach of these Terms after notice and a reasonable cure period, except where the breach poses an immediate risk to the Service or to other customers.

6. Disclaimers and liability

The Service is provided on an “as is” basis. To the maximum extent permitted by applicable law, Peak Enterprise disclaims all warranties not expressly stated in these Terms. The binding text on warranties, indemnities, and limitation of liability ships with the post-counsel revision.

7. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada. Disputes are subject to the exclusive jurisdiction of the courts of Ontario.
